As custodians of the public funds, Public Bank Group (“the Bank”) views integrity and compliance with regulatory and the Bank’s requirements as part and parcel of its business operations.
To further solidify the Bank’s fundamentals in this aspect, the Bank has established the Public Bank Group Anti-Bribery and Anti-Corruption (“ABAC Policy”) Policy in line with the requirements of Section 17A of the Malaysian Anti-Corruption Commission Act 2009 (“MACC Act 2009”) which introduces the notion of corporate liability for commercial organisation, effective from 1 June 2020.
The Bank adopts a zero-tolerance approach towards any form of bribery and corruption in its business conduct in an effort towards corrupt-free business environment. In adhering to the ABAC Policy, all members of the Board of Directors, staff and third parties must uphold the highest standard of integrity and accountability in discharging their duties.
Any commercial organisation who commits an offence under Section 17A of MACC Act 2009 shall be liable to a fine not less than ten (10) times the sum or value of the offences committed or RM 1 million, whichever is higher, or maximum imprisonment not exceeding twenty (20) years or both.
Due to the seriousness of the offence and as part of the Bank’s culture, the Bank had sought to be attuned to the requirements of the Guidelines on Adequate Procedure (“Guidelines”) issued by the Prime Minister’s Department on 4 December 2018, long before the enforceable date for Section 17A of MACC Act 2009 on 1 June 2020, with the aim of safeguarding the interests of all stakeholders. This includes the establishment of the Ethics and Integrity Working Group in October 2019 to oversee the management of anti-bribery and anti-corruption programme and to promote a culture of integrity within the Bank.
The Bank has also engaged a reputable experienced consultant in December 2019 to conduct Adequate Procedures Review on the Bank to be in compliance with the Guidelines. Members of the Board of Directors and Senior Management have a better grasp and understanding of the corporate liability provision and acquired necessary knowledge and skills to maintain good corporate governance practices in the Bank through the engagement session.
Such initiatives are the foundation of the Bank’s commitment towards fulfilling and supporting the country’s efforts in combatting corruption in various institutions and to provide the future generation with a corruption free ecosystem that will benefit everyone in the long term.
